Scope of This Policy

This Website and Platform Privacy Policy (the “Policy”) explains how CVC Unlimited, Inc., doing business as Liquid Helix (“Liquid Helix,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects Personal Information when you visit or interact with our websites, use Helix Hub, register for or attend a Liquid Helix recruiting showcase, communicate with us, or otherwise use a service that links to this Policy (collectively, the “Services”).

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household. It does not include information that has been lawfully made public, aggregated information, or information that has been deidentified so that it cannot reasonably be linked to an individual.

“Player Data” means nonpublic Personal Information concerning a current or prospective player, including identity and contact information, age-related and parent or guardian information, school and graduation information, academic or eligibility information, esports titles and gamer identifiers, roles, rankings, statistics, competitive history, gameplay or video links, evaluations, recruiting preferences, communications, attendance, and account information.

This Policy supplements applicable registration terms, waivers, media releases, event rules, and other agreements. If a separate agreement provides additional privacy protections for a specific event or activity, those additional protections continue to apply.

Personal Information We Collect

Information you or another authorized person provides
  • Account and contact information. Name, email address, telephone number, mailing or billing address, username, password or authentication information, role, communication preferences, and account status.
  • Player recruiting information. High school, graduation year, grade or academic information, esports titles, gamer tags or platform identifiers, positions or roles, ranks, statistics, competitive experience, teams, achievements, gameplay or video links, recruiting interests and preferences, and other profile information submitted for recruiting purposes.
  • Age and parent or guardian information. Date of birth or other age-related information used to confirm eligibility and determine whether the player is a minor, plus a parent or guardian’s name, email address, relationship, consent, waiver acceptance, and related acceptance records when the player is under age 18.
  • High-school and team information. School and program details, coach and staff information, team rosters, player names and email addresses provided to issue invitations, game-title selections, team assignments, coach verification records, school logos or materials, and purchase-order or billing information.
  • College coach and institution information. Name, professional email, telephone number, title, institution, program details, recruiting interests, event registrations, approval status, attendance, and account-access records.
  • Event, transaction, and waiver information. Showcase selections, registrations, fees, order and payment status, transaction identifiers, refunds, waivers, electronic signatures, timestamps, consent records, event attendance, and related administrative records.
  • Communications and submissions. Information contained in emails, forms, support requests, surveys, interviews, testimonials, feedback, and other communications with Liquid Helix.
  • Event media and participation information. Photographs, video, audio, livestream footage, statements, interviews, gameplay, and event participation information, subject to the applicable waiver, media authorization, and event rules.
Information collected automatically

When you use the Services, we and our service providers may automatically collect internet and device information, such as IP address, approximate location derived from IP address, browser and device type, operating system, referring page, pages viewed, links selected, session activity, dates and times, cookie or similar identifiers, login and access logs, and diagnostic, security, and error information.

Information from schools, organizations, and other sources

We may receive information from high-school coaches, school personnel, parents or guardians, college coaches, institutions, event hosts, payment and technology providers, and other people involved in the Services. For legitimate business outreach, we may also obtain adult professional contact information from public school and college directories, program websites, league or association listings, professional profiles, referrals, or other lawful public or commercial sources.

Please do not submit medical information, disability information, allergies, emergency medical details, Social Security numbers, government identification numbers, financial-account credentials, race or ethnicity, or other sensitive information unless Liquid Helix specifically requests it through an authorized process. Helix Hub does not currently request those categories as part of a player recruiting profile.

How We Use Personal Information

We may use Personal Information for the following purposes:

  • Provide, operate, maintain, and improve the Services, Helix Hub, and recruiting showcases.
  • Create and administer accounts; authenticate users; approve coach access; and maintain platform security.
  • Register schools, teams, players, coaches, and institutions; process rosters and invitations; schedule events; and provide event support.
  • Build, verify, organize, and provide access to recruiting profiles, event rosters, recruiting binders, player stat cards, search tools, and related recruiting resources.
  • Enable appropriate communications among players, parents or guardians, high-school coaches, college coaches, and Liquid Helix personnel.
  • Process payments, purchase orders, refunds, and transaction records; prevent fraud; and perform accounting and tax functions.
  • Obtain, record, and administer consents, waivers, electronic signatures, media permissions, and event rules.
  • Send transactional messages, account notifications, event updates, recruiting information, and, where permitted, promotional communications.
  • Measure website and campaign performance; understand use of the Services; troubleshoot; develop features; and improve user experience.
  • Create aggregated or deidentified attendance, engagement, regional benchmarking, and program information for planning, research, reporting, platform improvement, and sponsor or partner reporting.
  • Protect players, families, coaches, institutions, staff, venues, and the Services; investigate misuse or misconduct; enforce our agreements; respond to incidents; and comply with law.

Liquid Helix does not make college admission, scholarship, financial-aid, roster, or recruiting decisions. Those decisions are made independently by colleges, coaches, and institutions.

How We Disclose Personal Information

Players, parents or guardians, and high-school personnel

We may make a player’s profile and related event information available to the player, the player’s parent or guardian when applicable, the player’s high-school coach, and other school personnel authorized to administer the team, verify information, support the player, or manage Showcase participation.

Approved college coaches and institutions

We may provide approved college coaches attending the applicable Showcase with recruiting information for players who opted into the recruiting process. Depending on the event and access level, this may include an event roster or binder containing a player number, name, high school, game title, and contact information, as well as online access to additional academic, recruiting, contact, and title-specific profile information.

College-coach access is limited to legitimate recruiting, evaluation, admissions, eligibility, financial-aid, compliance, and roster-related purposes for the coach’s identified institution. Approved coaches are subject to confidentiality, security, limited-use, and deletion obligations. They may share Player Data internally only with authorized institutional personnel who have a legitimate need to know and appropriate privacy or professional obligations.

Service providers

We may disclose Personal Information to vendors and contractors that perform services for us and are permitted to use the information only for authorized purposes. These providers may include:

  • Cloud hosting and infrastructure providers, including our Cloudways-hosted environment using Amazon Web Services infrastructure.
  • Website, commerce, registration, and content-management providers, including WordPress and WooCommerce.
  • Customer relationship management, form, email, and communications providers, including HubSpot.
  • Payment processors, including Stripe. Liquid Helix does not receive or store complete payment-card numbers processed by the payment provider.
  • Analytics providers, including Google Analytics.
  • Authentication, security, support, professional-services, event-production, photography, video, livestream, and media-distribution providers.
Event hosts, venues, and operational partners

We may provide limited information to a Showcase host, venue, institutional partner, game or technology provider, insurer, security provider, or operational partner when reasonably necessary to credential participants, provide equipment or access, operate the event, address safety or misconduct, or fulfill an authorized event function.

Sponsors and advertisers

We do not disclose Player Data to sponsors or advertisers for their independent marketing and do not permit sponsors or advertisers to use Player Data for targeted advertising. We may provide sponsors with aggregated or deidentified attendance, engagement, campaign, or event-performance information that does not identify a player.

An adult coach or other adult business contact may separately and voluntarily opt in to receive information from a sponsor. A sponsor-branded QR code, landing page, promotion, or form should identify the sponsor or intended recipient and explain the applicable data use at the point of collection. Sponsor activations are limited to adults. We do not provide Player Data to a sponsor through such activities, including when a player interacts with a sponsor-branded QR code, landing page, promotion, or form.

Legal, safety, and corporate purposes

We may disclose Personal Information when we reasonably believe disclosure is required by law, legal process, court order, or governmental request; is necessary to prevent or investigate fraud, misconduct, exploitation, threats, security incidents, or harm; is needed to enforce our agreements or protect rights and property; or is otherwise permitted by law. We may also disclose information to professional advisers, insurers, auditors, and financing sources subject to appropriate duties.

If Liquid Helix or relevant assets are involved in a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets, Personal Information may be reviewed or transferred as part of that transaction, subject to applicable law and continued protection consistent with this Policy or notice of a material change.

Player and Minor Privacy
Minimum age

The Services are not intended for children under age 13. A person under 13 may not create a Helix Hub account or recruiting profile, and coaches and schools should not submit roster information for a person they know is under 13. If we learn that we collected Personal Information online from a child under 13, we will take reasonable steps to delete it, except as needed to protect the child, respond to the parent, comply with law, or document the deletion.

Players under age 18

A player who is under age 18 must provide parent or guardian contact information and complete the minor registration process. The parent or legal guardian must complete the applicable consent, waiver, recruiting-data authorization, and media choices before the minor’s registration is complete or the minor’s profile is released for recruiting access.

Nonpublic profiles and restricted use

Player profiles are not public directories. Player Data is provided only to the authorized recipients described in this Policy and for the disclosed recruiting, event, safety, legal, and operational purposes. Access may be logged, restricted, suspended, or revoked to protect players or the Services.

No sale or targeted advertising involving Player Data

Liquid Helix does not sell Player Data or known minor data for money or other valuable consideration. We do not share Player Data or known minor data for cross-context behavioral advertising, use player recruiting profiles to target advertising, or knowingly permit third-party advertising technologies to build advertising profiles from authenticated player-account activity.

School-provided information and FERPA

Schools and school personnel are responsible for having appropriate authority to provide roster or other student information to Liquid Helix. Before a player completes a profile, Liquid Helix generally asks the high-school coach only for the player’s name and email address so that an invitation can be sent. The player and, for a minor, the parent or guardian then provide and authorize the recruiting-profile information and applicable disclosures.

This Policy does not by itself designate Liquid Helix as a “school official” under the Family Educational Rights and Privacy Act (“FERPA”) or authorize a school to disclose education records without consent. If Liquid Helix separately agrees in writing to act for a school in a manner governed by FERPA or another student-privacy law, that agreement may impose additional requirements.

Cookies, Analytics, and Digital Advertising

We and our providers may use cookies, pixels, tags, local storage, and similar technologies for the following purposes:

  • Essential functions, including authentication, account sessions, transaction processing, security, load balancing, and fraud prevention.
  • Preferences and functionality, including remembering selections and improving forms and navigation.
  • Analytics and measurement, including Google Analytics and HubSpot tools that help us understand website use, form activity, email engagement, and campaign performance.
  • Advertising and outreach, if activated, to measure campaigns or reach adult and general-audience visitors without using Player Data or known minor data.

You may control cookies through browser settings and, where provided, our cookie or privacy-preference tools. Blocking some technologies may affect account login, registration, checkout, or other functionality.

We may add adult/general-audience advertising or remarketing technologies in the future. Before activating a practice that applicable law treats as targeted advertising, a “sale,” or “sharing” of Personal Information, we will provide any required notice and opt-out mechanism and will update this Policy when the change is material. These technologies will not be authorized to use Player Data or known minor data for targeted advertising.

Because there is no uniform industry standard for browser “Do Not Track” signals, the Services may not respond to those signals. Where required by applicable law, we will recognize legally applicable opt-out preference signals, such as Global Privacy Control, for the browser or device sending the signal once an applicable sale, sharing, or targeted-advertising practice is enabled.

Payments

Payments are processed by third-party payment providers such as Stripe through our website and commerce systems. Payment providers receive payment-card and transaction information directly under their own privacy practices. Liquid Helix generally receives transaction confirmation, amount, status, limited payment-method details, billing information, and identifiers needed for accounting, support, refunds, and fraud prevention, but not the complete payment-card number.

Photography, Video, Livestreams, and Publicity

Showcases may be photographed, filmed, recorded, or livestreamed by Liquid Helix or by authorized photographers, production companies, host institutions, event partners, media outlets, or distribution providers. Collection and use of identifiable event media is governed by the applicable waiver, media release, registration choices, event notices, and law.

Authorized event media may be used to operate, livestream, document, archive, recap, and promote the Showcase and Liquid Helix’s recruiting-showcase program. Public event media may be viewed, copied, or redistributed by others, and we may not be able to remove every copy after lawful publication. Public event media does not make a player’s nonpublic Helix Hub recruiting profile public.

Aggregated and Deidentified Information

We may aggregate or deidentify information so that it cannot reasonably be linked to an individual. We may use and disclose aggregated or deidentified information for benchmarking, event and program reporting, sponsor reporting, research, planning, analytics, platform improvement, and other lawful purposes. Where required by law, we will maintain such information in deidentified form and will not attempt to reidentify it except to test our deidentification processes or as otherwise permitted by law.

Data Retention

We retain Personal Information for no longer than reasonably necessary for the purposes described in this Policy, including providing continuing recruiting-profile access, administering accounts and events, honoring user choices, maintaining business and financial records, protecting safety and security, resolving disputes, enforcing agreements, and complying with law. Retention depends on the nature and sensitivity of the information, account and event activity, graduation year, recruiting purpose, legal requirements, limitation periods, and the feasibility of deletion from backups.

When retention is no longer necessary, we may delete, destroy, aggregate, or deidentify the information. Information in backups may remain until the backup is overwritten or expires, provided it is isolated from ordinary use. A college or school that lawfully received information may maintain its own authorized recruiting or institutional records under its policies and legal obligations.

Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information, taking into account the nature of the information, our size, and the Services we provide. Measures may include role-based access, authentication, access logging, vendor controls, backups, monitoring, and incident-response procedures. We also require authorized coaches to protect Player Data and limit its use and internal disclosure.

No method of transmission, storage, or security is completely reliable. You are responsible for protecting your password and account, using only authorized devices and networks, and notifying us promptly of suspected account compromise or misuse.

Your Privacy Rights and Choices

Subject to identity verification, legal exceptions, and the law applicable where you live, you may have the right to:

  • Confirm whether we process Personal Information about you and request access to it.
  • Request correction of inaccurate Personal Information.
  • Request deletion of Personal Information.
  • Obtain a portable copy of certain Personal Information you provided.
  • Opt out of targeted advertising, sale, or sharing of Personal Information if we engage in a covered practice.
  • Limit certain uses of sensitive Personal Information, where applicable.
  • Appeal our denial of a privacy request where applicable law provides an appeal right.
  • Exercise rights without unlawful discrimination.

A parent or legal guardian may submit a request concerning a minor player. An authorized agent may submit a request where permitted by law, but we may require proof of authority and direct verification with the individual. We may deny or limit a request when an exception applies, including where information is needed for security, fraud prevention, legal compliance, transactions, recordkeeping, claims, free-expression rights, or another lawful purpose.

To submit a privacy request, email privacy@liquidhelix.gg with the subject line “Privacy Request.” Describe the request, identify the account or relationship involved, and provide enough information for us to locate the relevant records. Do not send a password, full payment-card number, Social Security number, or government identification by ordinary email. We will verify and respond within the time required by applicable law.

Communications Choices

You may unsubscribe from promotional emails through the unsubscribe link in the message or by contacting us. We may continue sending nonpromotional communications relating to accounts, transactions, waivers, safety, event administration, support, or legal notices. You may update account and profile information through Helix Hub where that functionality is available or by contacting us.

Third-Party Services and Links

The Services may link to college, school, venue, sponsor, social-media, livestream, game-publisher, payment, or other third-party websites and services. This Policy does not govern a third party’s independent collection or use of information. Review the third party’s privacy policy before providing information directly to that party.

United States Services and Processing

Liquid Helix is based in the United States, and the Services are directed to participants, schools, institutions, and other users in the United States. Personal Information may be processed and stored in the United States. The Services are not marketed or specifically directed to residents of the European Union, European Economic Area, United Kingdom, or other jurisdictions outside the United States.

Changes to This Policy

We may update this Policy as our Services, vendors, technologies, or legal obligations change. We will post the updated Policy and revise the “last updated” date. If a change materially affects how we use or disclose Player Data or other Personal Information previously collected, we will provide additional notice or obtain consent when required by law or an applicable agreement.
